Throughout these Terms, the words “HIBA Fabrics,” “HIBA,” “we,” “us,” and “our” refer to HIBA Tekstil Ticaret Ltd. Şti. The words “you,” “your,” “customer,” and “user” refer to any person accessing or using our website or services.

By accessing our website, using our services, placing an order, creating a customer account, or contacting us for retail or wholesale fabric enquiries, you agree to be bound by these Terms of Service, our Privacy Policy, our Shipping Policy, and our Return, Refund & Cancellation Policy.

HIBA Fabrics operates an online fabric store offering fabric by the meter, fabric swatches, retail fabric orders, wholesale fabric supply, bulk fabric orders, and related fabric services. We serve customers in Türkiye, the United States, Canada, the United Kingdom, Australia, the United Arab Emirates, Saudi Arabia, Europe, and other international destinations.

Our website is powered by Shopify, which provides the e-commerce platform that allows us to sell products and services online.

HIBA Fabrics offers fashion fabrics, bridal fabrics, eveningwear fabrics, modest fashion fabrics, abaya fabrics, stretch fabrics, luxury fabrics, fabric swatches, retail meter orders, wholesale fabric supply, bulk fabric orders, and roll orders.

We make reasonable efforts to describe our fabrics accurately, including information such as fabric type, composition, width, weight, stretch, drape, transparency, texture, colour, finish, and suggested use where available.

Product descriptions, specifications, pricing, availability, and images may be updated, changed, corrected, or discontinued at any time without notice.

5. Fabric Colour, Texture and Appearance

We work carefully to display fabric colours, textures, finishes, shine, transparency, and drape as accurately as possible through product photography, videos, and descriptions.

However, fabric colours and appearance may vary depending on screen settings, device type, monitor calibration, lighting conditions, photography, fabric surface reflection, dye lot, production batch, and viewing environment.

Slight differences in colour, texture, shine, stretch, drape, transparency, weight, or appearance are not normally considered defects.

For important projects, bridalwear, eveningwear, abayas, modest fashion, production runs, or wholesale fabric orders, we strongly recommend ordering a fabric swatch before purchasing larger quantities.

6. Fabric Swatches

Fabric swatches are offered to help customers evaluate colour, texture, weight, stretch, transparency, drape, shine, and general suitability before placing a larger order.

Swatches are intended as a guide. There may still be slight variation between a swatch and later fabric orders due to dye lot, production batch, lighting, and material behaviour.

Swatches are normally final sale unless the wrong swatch was sent or the swatch arrives damaged, defective, incorrect, or not as described.

7. Orders and Acceptance

When you place an order through our website, you are making an offer to purchase the products in your cart.

We reserve the right to accept, refuse, cancel, or limit any order at our discretion, including where there is a pricing error, stock issue, payment issue, suspected fraud, shipping restriction, incorrect customer information, or other problem with the order.

Your order is accepted only when payment has been processed and we confirm the order. We may contact you using the email address, phone number, billing address, or shipping address provided at checkout.

Receiving an order confirmation does not guarantee that all products are available, that pricing or product information is error-free, or that the order can be shipped to every destination.

8. Cancellations Before Fulfillment

You may request to cancel your order at any time before the item or order is fulfilled.

If your order has not yet been fulfilled, we will cancel the order and issue a refund to your original payment method where possible.

Once an item or order has been fulfilled, dispatched, shipped, or handed over to the carrier, it can no longer be cancelled. If your order has already been fulfilled, any return or refund request will be handled according to our Return, Refund & Cancellation Policy.

9. Cut Fabric and Custom Lengths

Fabric sold by the meter or cut to a requested length is prepared specifically for the customer.

Once fabric has been cut to the length requested in your order and the item or order has been fulfilled, it cannot normally be returned, exchanged, or refunded for change of mind.

This applies to fabric sold by the meter, custom lengths, special requests, wholesale cut orders, bulk cut orders, and roll orders where applicable.

This rule does not affect your legal rights if the product is confirmed to be damaged, defective, incorrect, or not as described.

Please review fabric details carefully before placing an order. If you are unsure about colour, texture, weight, transparency, stretch, drape, shine, or suitability, we recommend ordering a swatch first.

10. Measurement and Cutting Tolerance

Fabric is measured and cut with care. Minor measurement or cutting variations may occur due to fabric stretch, rolling, handling, cutting method, or material behaviour.

Small variations are not normally considered defects unless they are significant and affect the normal use of the fabric.

11. Wholesale Fabric Orders

HIBA Fabrics welcomes wholesale enquiries from fashion brands, boutiques, designers, tailors, garment manufacturers, costume departments, textile retailers, sourcing companies, and other business customers.

Wholesale enquiries may be submitted through product pages, WhatsApp, email, customer support channels, or other contact methods. A wholesale enquiry does not create a binding order until pricing, quantity, availability, payment terms, shipping terms, and order details are confirmed by HIBA Fabrics.

Wholesale fabric orders, roll orders, bulk orders, custom sourcing requests, and special-order products are normally final sale once fulfilled, dispatched, shipped, or otherwise confirmed as final according to the agreed wholesale terms.

Wholesale customers are responsible for reviewing fabric details, quantity, pricing, colour, stock availability, shipping terms, customs duties, taxes, import requirements, and suitability before confirming an order.

12. Pricing, Currency and Promotions

Prices are displayed in the currency shown on the website or at checkout. HIBA Fabrics may use Shopify Markets, currency conversion, or localized pricing features to display prices for different regions.

Unless stated otherwise, product prices do not include shipping charges, customs duties, VAT, import taxes, brokerage fees, clearance fees, or other local charges.

Prices, discounts, promotions, shipping rates, product availability, and product information may change at any time without notice.

Promotional offers may be subject to additional terms, conditions, limits, expiry dates, minimum order values, regional restrictions, product exclusions, or usage limits.

We reserve the right to correct pricing errors, cancel orders affected by errors, or refuse orders where pricing or promotion information was displayed incorrectly.

13. Payment

You agree to provide current, complete, and accurate payment and billing information for all purchases.

Payments are processed through Shopify and/or approved third-party payment providers. We do not directly store full credit card details on our own systems.

We reserve the right to cancel, hold, or delay an order if payment is declined, flagged for fraud, reversed, disputed, incomplete, or otherwise not completed successfully.

You are responsible for any fees, chargebacks, payment disputes, currency conversion charges, or payment provider charges that may apply to your transaction, unless otherwise required by applicable law.

14. Shipping and Delivery

Shipping options, estimated delivery times, and available shipping rates are displayed at checkout where applicable.

Delivery times are estimates only and are not guaranteed unless a guaranteed delivery service is specifically stated at checkout.

We are not responsible for delays caused by couriers, customs processing, local authorities, weather, public holidays, incorrect addresses, peak seasons, force majeure events, or circumstances outside our reasonable control.

15. Customs, Duties, Taxes and Import Charges

International orders may be subject to customs duties, VAT, import taxes, brokerage fees, clearance fees, or other government charges depending on the destination country.

These charges are determined by local authorities and are the responsibility of the customer unless otherwise stated during checkout or required by applicable law.

HIBA Fabrics cannot control customs processing times, customs inspections, import restrictions, or charges imposed by destination countries.

Customers are responsible for checking whether fabric imports are subject to any restrictions, duties, taxes, or special requirements in their destination country before placing an order.

16. Returns, Refunds and Cancellations

Returns, refunds, exchanges, cancellations, damaged orders, incorrect orders, swatches, cut fabric, custom lengths, wholesale orders, and final sale items are handled according to our Return, Refund & Cancellation Policy.

Because most fabric orders are cut to customer-requested lengths, cut fabric cannot normally be returned, exchanged, or refunded for change of mind once the item or order has been fulfilled.

17. EU and International Consumer Rights

Nothing in these Terms is intended to limit any mandatory rights you may have under applicable consumer protection laws.

If you are located in the European Union, the United Kingdom, Canada, the United States, Türkiye, or another jurisdiction with mandatory consumer protection rules, those rights will apply where required by law.

For EU customers, certain eligible online purchases may be subject to a 14-day withdrawal right. However, this right may not apply to goods made to the customer’s specifications or clearly personalized, including fabric cut to the specific length requested by the customer, unless the item is damaged, defective, incorrect, or not as described.

18. Product Availability and Stock

Product availability, colour availability, roll availability, stock quantities, and wholesale quantities may change at any time.

We reserve the right to limit quantities, discontinue products, cancel unavailable items, or contact you regarding substitutions, delays, stock issues, or order changes.

If an item becomes unavailable after you place an order, we may contact you to offer a substitute, partial shipment, delay notice, refund, or cancellation.

19. Errors, Inaccuracies and Omissions

Occasionally, our website may contain errors, inaccuracies, or omissions related to product descriptions, specifications, colours, pricing, promotions, shipping charges, stock availability, delivery times, taxes, duties, or other content.

We reserve the right to correct errors, update information, change or cancel orders, or refuse orders if any information is inaccurate, even after an order has been submitted.

Customers are responsible for confirming whether a fabric is suitable for their specific project, garment, production method, climate, care requirements, or commercial use.

We recommend testing fabrics before production, sewing, dyeing, washing, printing, pleating, heat pressing, embroidery, or any other treatment.

21. Fabric Care and Use

Any care instructions, washing guidance, ironing suggestions, or usage recommendations provided by HIBA Fabrics are general guidance only unless stated otherwise.

Fabric behaviour may vary depending on composition, finish, treatment, dye lot, washing method, sewing method, and how the fabric is used.

Customers are responsible for testing fabric before cutting, sewing, washing, altering, or using it in production.

22. Intellectual Property

All content on this website, including text, product descriptions, images, videos, graphics, logos, branding, page design, layout, icons, product photography, product data, and other materials, is owned by or licensed to HIBA Fabrics unless otherwise stated.

You may not copy, reproduce, distribute, modify, scrape, download, store, publish, sell, train on, or commercially exploit our website content without our prior written permission.

HIBA Fabrics names, logos, product names, designs, photography, and branding may not be used without our prior written consent.

23. Reviews, Feedback and User Submissions

To the fullest extent permitted by applicable law, HIBA Fabrics, its owners, directors, officers, employees, contractors, suppliers, partners, service providers, and affiliates will not be liable for any indirect, incidental, special, punitive, consequential, or similar damages arising from your use of our website, services, or products.

This includes, without limitation, loss of profits, loss of revenue, loss of savings, loss of data, production delays, garment production issues, replacement costs, loss of business opportunity, or business interruption.
